Individual Access

9.1
  • Upon receipt of an appropriate written request from an individual for access to, copies of, or the right to examine a record containing, Personal Information about the individual, Quadrus shall, after taking into consideration what is reasonable, provide that individual with:
9.1.1
  • reasonable assistance with the individual's request;
9.1.2
  • information of a logistical nature respecting Quadrus' response to the individual's request, as required by applicable privacy legislation;
9.1.3
  • access to the individual's Personal Information that is contained in a record under the custody or control of Quadrus, unless refusal to provide such access is required or permitted by applicable privacy legislation (the "Accessible Personal Information");
9.1.4
  • the purposes for which Accessible Personal Information has been used and is being used by Quadrus;
9.1.5
  • the names of the persons to whom and circumstances in which the Accessible Personal Information has been and is being disclosed;
9.1.6
  • where requested by the individual, a copy of the Accessible Personal Information or a copy of or right to examine the record or parts of the record containing the Accessible Personal Information;
9.1.7
  • a record created by Quadrus in respect of the individual’s request and Accessible Personal Information, unless not required or permitted not to by applicable privacy legislation; and
9.1.8
  • information on the individual’s right to request a review of Quadrus’ response by a legislatively appointed privacy commissioner, where permitted by applicable privacy legislation.
9.2
  • There are certain circumstances identified by applicable privacy legislation in which Quadrus is not required or permitted not to provide an individual with access to, copies of, or the right to examine a record containing, the individual’s Personal Information. By way of example only, Quadrus is not required to provide an individual with access to, copies of, or the right to examine a record containing, the individual’s Personal Information where:
9.2.1
  • the Personal Information is protected by legal privilege;
9.2.2
  • the disclosure of the Personal Information would reveal confidential commercial information and Quadrus is not reasonably able to sever the Personal Information from the confidential commercial information;
9.2.3
  • the Personal Information was collected for an investigation or legal proceeding;
9.2.4
  • the disclosure of the Personal Information could reasonably be expected to threaten the life or security of another individual and Quadrus is not reasonably able to sever the Personal Information from the possibility of such threat;
9.2.5
  • the disclosure of the Personal Information could reasonably be expected to reveal Personal Information about another individual and Quadrus is not reasonably able to sever the requested Personal Information from the other Personal Information.
9.3
  • In circumstances in which Quadrus is not required or permitted not to provide an individual with access to, copies of, or the right to examine a record containing, the individual’s Personal Information, Quadrus shall provide the individual with a written response containing the reasons for such refusal, the provisions of applicable privacy legislation on which such refusal is based and information on the individual’s right to request a review of Quadrus’ response by a legislatively appointed privacy commissioner, where permitted by applicable privacy legislation.
9.4
  • Quadrus may, where permitted by applicable privacy legislation, charge an individual requesting access to, copies or the right to examine, the Personal Information of the individual in the custody or control of Quadrus, a reasonable fee and deposit for access to, copies of or the right to examine accessible Personal Information and in such cases Quadrus shall give the individual a prior written estimate of such total fee.
9.5
  • Upon receipt of a written request from an individual to correct an error or omission in the Personal Information about the individual that is in the control of Quadrus, Quadrus shall, where there is such an error or omission:
9.5.1
  • correct the Personal Information as soon as reasonably possible or where permitted by applicable privacy legislation determine not to correct the Personal Information and annotate the Personal Information with the correction that was requested but not made; and
9.5.2
  • send a notification containing the corrected Personal Information to each organization to which Quadrus has disclosed the Personal Information, if Quadrus is reasonably able to do so.
9.6
  • A written request by an individual to obtain access to, copies of, or the right to examine a record containing, the individual’s Personal Information, or for a correction to an individual’s Personal Information, must set out sufficient detail to enable Quadrus, with reasonable effort, to identify the Personal Information in respect of which such written request was made.
